Disclaimer!

Hi everyone, I’m making a wedding cake for a bride very soon and the function is at a hotel (in Scotland). Although I have supplied all my hygiene certificates to the hotel, they have sent a ‘disclaimer’ form to the bride for me to fill in which basically asks me to sign to the fact that they are void of any liability should there be any issues with my cake. I’ve made lots of cakes for venues and have never had this before; I’d be lying if I wasn’t a bit nervous about it! I’m not worried about the cake at all but does this not open up all sorts of loopholes and potential problems as once the cake is there I don’t know what could happen to it? Help!

Hello Mrsthedo

The venue has asked for the disclaimer because the cakes are food brought in to their premesis rather than which have been produced by them. They have to cover themselves from an insurance liability stand. If you are concerned that the cake will become damaged after you have set up and left the premesis take photographs of it from all angles to show it was left undamaged and in excellent condition. Send pictures to the bride and to the venue and of course keep some for your own record and of course for any other problems which may arise you will have your public own liability and products insurance to protect you.
Hope this helps.

Thank you very much, I was concerned that my own insurance might be invalidated if I signed this but I am probably over thinking it!! Many thanks

If you are still concerned about invalidating your own insurance give your company a call and just let them know that you have been asked to sign this disclaimer. This way everyone is reading off the same page and there can be no confusion.
