User Agreement

We want your experience on the site to be fun, informative, enjoyable and safe. To ensure this there are some ground rules that we need you and all fellow users to abide by whether on the CakeFlix website or Facebook Groups :

1. Welcome

  1. In registering on this site you agree to comply with the terms set out in this user agreement.

  2. Our aim is to make the terms concise and not too wordy so you can get on with enjoying the experience.

  3. By continuing to use this website site you’re making a legal agreement to comply with these terms.

  4. If you can’t, or don’t want to, accept these terms, then you should stop using the site now as reading further or entering any other part of the site you are entering into an agreement whereby you accept the terms.

  5. Occasionally we might update our terms and we’ll post information about that on our sites and members will be notified through our weekly newsletter. When we let you know that our terms have changed, please read them to see how they affect you, as they will apply from the time they are changed.

  6. We take your data security very seriously so have a look at our data privacy statement.

2. Our content

  1. When we mention ‘content’, we’re talking about all the content on the site which includes tutorials, blogs, images, graphics, logos, icons, sound clips, Q&A answers, data compilations and page layout.

  2. Only with express permission from the copyright holder can any content be copied or in any way or replicated as to do so would be in breach International intellectual property and other laws. The cakes made in the tutorials can of course be replicated as shown and do not constitute a breach of these rules, but using our promotional image or material does.

  3. You can’t store, copy, distribute, reproduce or use the content in any other way than its intended purpose which is to be viewed on the site.

What you can do:

  1. We want you to get as much learning and enjoyment from the site as possible so we are happy to give you permission to use the site in exchange for accepting our terms and complying with them.

  2. You can use the learnings from the site for both personal and commercial use.

  3. You can adapt, change or manipulate the designs shown here in any way you choose.

What you can’t do:

  1. You can’t attempt to replicate any of the site content or framework.

  2. You can’t share your log in details with anyone. There is software working in the background to ensure that one user uses one membership, but we know our members wouldn’t want to do that anyway!

  3. You can’t advertise your products or company using this site or any other media owned by Paul Bradford Sugarcraft School without the written permission of the owner.

3. Your content

  1. We are keen for you to be proactive in our Q&A section and other media where interaction is sought.

  2. You retain ownership of any intellectual property but by posting it on our site you’re giving us permission (a license) to use it. This permission includes allowing us to publish it (or not), to move it to a more appropriate forum, to store or delete it.

Treat others users with respect

  1. We encourage your feedback and interaction in all manner of means and have a very liberal policy in terms of acceptable content.

  2. Your content will be shared and viewed by all members on the site who come from a wide range of backgrounds so all content must be respectful of that and ensure that it:

    1. Does not offend or affect other users enjoyment of the site or social media groups

    2. Is not false, misleading, fraudulent, unlawful, abusive, harassing, defamatory, obscene, vulgar, or offensive;

    3. Does not infringe others’ rights, including privacy or intellectual property rights;

    4. Does not disclose personal information about others, particularly sensitive information;

    5. Does not contains a virus, spyware, or other harmful component;

    6. Does not contain commercial solicitation or ‘spam’.

  3. We retain the right to take down any user content for any reason at all without notice and without providing a reason. We’re not liable for any content posted by others on our sites.

4. Things you can’t do

In using the sites you agree that you will not:

  1. Use a false email address, impersonate others, or misrepresent your affiliation with others;

  2. Attempt to gain unauthorised access to computer systems or materials through Paul Bradford Sugarcraft School.

  3. Gather information on other members or site users.

  4. Attempt to interrupt or our day to day operation in any way (for example through sending mass unsolicited messages, “flooding” servers, or introducing a virus, time bomb, trojan horse, worm, cancelbot or other computer routine );

  5. Use our site or any of its content in a way that violates applicable law, that violates the intellectual property or other rights of us or others, or that is fraudulent, obscene, offensive, misleading or defamatory.

5. Membership agreement

  1. You can cancel your membership at any time, which will stop your recurring payments, by contacting us.

  2. There’s no notice period required so once you’ve cancelled there will be no more payments taken, but of course we hope you come back.

  3. Once you’ve joined you have access for the duration of the membership you signed up for whether it’s annual or monthly. Refunds won’t be given for unused memberships should you choose to cancel your membership within the duration of the original agreement. This also applies when your subscription payments commence, after a free trial period.

  4. Memberships are set up on a recurring basis which means that on the monthly, 6 monthly or annual anniversary another payment will be taken which will always be the same as the one you signed up on. In legal terms it’s a rolling contract.

  5. If there are insufficient funds in your account or your payment is not received for whatever reason we have the right to request the payment again until payments been received.

  6. We reserve the right to cancel or suspend memberships where any wrongdoing is suspected. This decision will be made by an internal panel and based on a balance of probabilities.

  7. Note that we use Vimeo as our video hosts. Some governments have banned the playing of Vimeo videos, which is beyond our control. Should you be affected you will be refunded for the period of unused membership.

6. Individual purchase tutorials

  1. On purchasing an individual tutorial you will automatically become a member of the site having access to all the free tutorials, Q&A as well as the tutorials that you’ve purchased.

  2. If for any reason you’re not completely satisfied with the tutorial you’ve purchased, then let us know within 30 days and we will provide a refund in return for the reason for your dissatisfaction.

  3. We reserve the right to cancel or suspend membership and access where any wrongdoing is suspected. This decision will be made by an internal panel and based on a balance of probabilities and the decision of the panel is final. Where wrongdoing is suspected no refund will be given.

7. Privacy

  1. Our information collection and use of any personal information about you is governed by GDPR. We can only use personal information that you disclose in relation to your use of the site and through our weekly newsletters, which offers the usual unsubscribe facility.

  2. We won’t sell your details to marketing companies and we won’t pass on your details unless we have to satisfy a law, regulation, government request or a legitimate business need.

  3. Bear in mind that any information that you post on our sites will become public information and can be collected and used by other parties (we don’t have control over that).

  4. We use harmless cookies on our site, take a look at our cookie policy here.

8. Legal speak

  1. We are governed by Scots Law in the operation of our business.

  2. CakeFlix is not liable to you for any loss, claim, injury or damage of any kind that is in any way related to your use this site. To the maximum extent permitted at law, we make no warranty of any kind about the information or other content provided on the site.

    I know this site saI’d free classes, but are there hidden fees? If I sign up for the free classes, does that automatically commit me to a membership?

      No hidden fees at all. When you join as a free member you don’t enter any payment details at all. Our hope is that you like what you see and ten move on to become a member once you’ve had the chance to see who we are and what we do.

      Even with our paying members we have no contract so you can cancel at any time via the website, your card provider or by contacting our customer support. Hope this helps, but if you have any further questions please contact [email protected].

    Hi David,
    I’m currently a premium member and I’m thinking of upgrading it to PRO.
    How does it work with the pricing, do I just pay the difference between the two membership? Or my premium membership got cancelled automatically and pay £99?

    Other qs is, If I want to downgrade back to premium from Pro member let’s say, 2 months after signed up, do I got charge £99 fee then also pay the premium membership on top of it? Please advise.

    I had a membership with the previous Paul Bradford site and had my login details saved so don’t remember them. I ourchased the membership only a few months ago so don’t want to pay again. Does my previous membership roll over to this new site?

      Yes, everything is as before. The company registration number is exactly the same so all previous contracts and agreements are as before with the company now trading as CakeFlix. You don’t need to do anything and the rate that you joined at will remain the rate that you pay.

    Hi,
    I am planning to enroll for PRO annual membership, however , I would like to pay for one year only, how can I ensure my enrollment will not be automatically renewed and payment is Deducted after this year automatically ?

      We award a certificate for the CakeFlix Master Programme, which is an externally accredited course regulated by FDQ. On the CakeFlix Master Programme we can verify the users work, which unfortunately can not be done in the same wy for our weekly tutorials.

    I would like to purchase a tutorial within my 7 day free trial. Once purchased is this mine to keep and use even if I cancel my membership?

      Hi Sue,

      As all tutorials are available as part of the Premium or Pro membership plans, the system doesn’t allow Premium or Pro members to purchase a lifetime access tutorial while they have access during their subscription plan. This is to protect members from inadvertently buying something that they already have access to. However, lifetime access tutorials can be purchased manually. Just get in touch with [email protected]. Let them know the tutorial that you want to purchase and they can send out an invoice for payment. Once paid, the tutorial is added to your account. Hope that helps, but let us know if you have any further questions at all.
